Fitness Industry Award Breaks

Breaks are an essential aspect of workplace regulations, ensuring that employees have adequate rest and time for meals during their shifts. In the Fitness Industry Award, where employees may be engaged in physically demanding activities, understanding the provisions for breaks under the relevant Award is crucial for both employers and employees.

Meal Breaks

Meal breaks, also known as lunch breaks, are periods during which employees are entitled to take an uninterrupted break to consume a meal.

Unpaid meal breaks

Employees must be provided with an unpaid meal break between 30 minutes and 60 minutes no later than 5 hours after the commencement of their shift. Employees must be provided with a second unpaid meal break if they work 5 hours after their first meal break.

Paid rest breaks

Employees must be provided with a paid 10 minute break before and after their meal break. Casual employees that work 3 hours or less are not entitled to a paid rest break.

Working through breaks

Employees required to work through a meal break must be paid 200% of the minimum hourly rate for all time that they work until a meal break is provided.

Provisions for Shift Workers

Shift workers, who may work irregular hours or overnight shifts, have specific provisions regarding breaks to ensure their health and safety. These provisions are outlined in the relevant Award and may include additional rest breaks or adjustments to meal break times for employees working non-standard hours. Employers must adhere to these provisions to ensure compliance with workplace regulations and promote the wellbeing of shift workers.

Compliance and Enforcement

Ensuring compliance with break provisions in the Fitness Industry Award is essential for maintaining a safe and healthy work environment. Employers are responsible for implementing policies and procedures that allow employees to take their entitled breaks and for monitoring compliance with these regulations. Failure to provide adequate breaks or interfering with employees’ break entitlements can result in penalties, fines, or legal action against the employer.
