Building and Construction Award Pay Guide

All employees must be classified as one of the classification levels set out in the Building and Construction Award which will in turn dictate the relevant minimum wage that they can be paid.

Methods of Payment
Employees may receive payments via cash, cheque, bank cheque, electronic funds transfer (EFT), or a combination of these methods. If paid by cheque, employees should have reasonable time during working hours to cash it. Payments must generally be available by the end of regular working hours on Thursdays each week.

Overtime Pay for Delayed Payments

If an employee paid in cash or by cheque waits more than 15 minutes past the usual pay day finishing time (due to reasons not beyond the employer’s control), they are entitled to overtime rates for the waiting period, with a minimum payment of 15 minutes.

Industry Allowances

Overview

Industry allowances are additional payments made to employees along with their weekly rate. Different allowances apply depending on the industry stream.

Inclusions in Payment

Industry allowances are included in the employee’s rate of pay for all purposes under the award, including penalties, loadings, and annual leave payments.

Expenses Allowances

Tools and Clothing Allowance

Employees must receive a tool and clothing allowance for the maintenance and provision of standard tools as outlined in the award.

Reimbursement

Employers must either reach an agreement to reimburse employees for tools and protective clothing or provide these items directly.

Meal Allowance

Employees working overtime for at least 1.5 hours after ordinary hours are entitled to a meal allowance, unless provided with suitable meal arrangements by the employer.

Operator Employees

Operator employees are entitled to a meal allowance for every 4-hour period of overtime worked.

Compensation for Clothes and Tools

Damage Compensation

Employees whose clothing, equipment, or tools are damaged during work due to corrosive substances must be compensated.

Reimbursement

Employers must reimburse employees for tools or clothes lost or damaged under specific circumstances outlined in the award.

Spectacles with Toughened Glass Lenses

Employers are responsible for the cost of toughening lenses for employees required to wear spectacles with toughened glass lenses.

Claims Procedure
Employees must provide a list of tools if requested, and thefts must be reported to the police before claiming reimbursement for stolen tools. Reimbursement is based on the replacement value of similar-quality new tools.
